Nasdaq, S&P 500 Climb To Best Closing Levels In Over Three Months

After recovering from early weakness to end Monday’s session mostly higher, stocks saw further upside during trading on Tuesday. With the continued upward move, the Nasdaq and the S&P 500 reached their best closing levels in over three months.

The major averages ended the day off their highs of the session but still firmly positive. The Nasdaq advanced 156.34 points or 0.8 percent to 19,398.96, the S&P 500 climbed 34.43 points or 0.6 percent to 5,970.37 and the Dow rose 214.16 points or 0.5 percent to 42,519.64.

The continued strength on Wall Street came following the release of a Labor Department report showing an unexpected increase by job openings in the U.S. in the month of April.

The Labor Department said job openings climbed to 7.391 million in April from an upwardly revised 7.200 million in March.

Economists had expected job openings to decrease to 7.100 million from the 7.192 million originally reported for the previous month.

The unexpected rebound by job openings partly reflected increases in job openings in the arts, entertainment, and recreation and mining and logging sectors.

“The higher-than-expected job openings number this morning is a good sign for the economy, as many were worried that the tariff uncertainty was weighing too heavily on businesses,” Chris Zaccarelli, Chief Investment Officer for Northlight Asset Management.

Meanwhile, traders continued to await further developments on the trade front a month ahead of the expiration of President Donald Trump’s 90-day tariff pause.

While tensions between the U.S. and China have seemingly risen in recent days, traders appear to remain generally optimistic about trade deals being reached.

“The 90-day pause on tariffs has just over a month before expiration, meaning the pressure is on countries to do deals with the Trump administration,” said Russ Mould, investment director at AJ Bell.

He added, “Reports suggest that Trump wants best offers on trade negotiations by Wednesday, perhaps to avoid any last-minute rush or stalemate situations.”

President Donald Trump is complaining that the Supreme Court justices he nominated, particularly Justice Amy Coney Barrett, are not standing behind his agenda, CNN reported.

Trump has been complaining about Barrett and the other justices he nominated, Neil Gorsuch and Brett Kavanaugh, for at least a year, sources told CNN. He believes Barrett is “weak” and her rulings are not in line with how she presented herself when she met with Trump in 2020, according to CNN.

Harrison Fields, principal deputy press secretary, said Trump stands with the Supreme Court.

“President Trump will always stand with the U.S. Supreme Court, unlike the Democrat Party, which, if given the opportunity, would pack the court, ultimately undermining its integrity. The President may disagree with the Court and some of its rulings, but he will always respect its foundational role.”

Conservatives were angered when Barrett voted to reject Trump’s plan to freeze $2 billion in foreign aid. Barrett also joined the court’s three liberal judges and Chief Justice John Roberts to rule that Trump could be sentenced following his felony conviction in his New York trial.

Barrett also recused herself in a case over whether a Catholic charter school in Oklahoma should be entitled to taxpayer funding. The court ruled 4-4, which left in place an Oklahoma Supreme Court ruling that the school was unconstitutional. Barrett recused herself because of a personal relationship with the attorneys representing the school.

Trump has declined to criticize Barrett and other Supreme Court justices publicly.

“He does truly respect the Supreme Court, so he doesn’t want to torch any of his appointees,” a senior White House official told CNN. “He’s called on them as a group to rein in the lower courts and do the right thing, but has intentionally not attacked any of the Justices by name.”

Barrett has sided with Justices Clarence Thomas and Samuel Alito, the two most conservative justices, 80% of the time, according to Emperil SCOTUS.

Last week, Trump tore into Federalist Society co-chair Leonard Leo, the man who had once advised him on his Supreme Court picks, calling him a “sleazebag” who “probably hates America” after a panel of judges said most of his tariffs were illegal.

“I was new to Washington, and it was suggested that I use The Federalist Society as a recommending source on Judges,” Trump posted on Truth Social late Thursday. “I did so, openly and freely, but then realized that they were under the thumb of a real ‘sleazebag’ named Leonard Leo, a bad person who, in his own way, probably hates America, and obviously has his own separate ambitions.”

Yes, that’s a cartoon of me. Louis Rukeyser had us dressed up in ‘elf’ costumes on the screen broadcast each week. I’ve dated myself. That occurred for me between 1988-1996. Lou didn’t like any bearish comments, so myself and other elves got dumped in 1996.

DISNEY IS AS GUILTY AS ABC – ABC NEEDS TO BE SOLD – PERHAPS TO THE DEMOCRATS OR PERHAPS COMMUNIST CHINA

FCC chair Brendan Carr sent a letter to Disney CEO Robert Iger stating, “Numerous reports indicate that Disney’s leadership went all in on invidious forms of D.E.I. discrimination a few years ago and did so in a manner that infected many aspects of your company’s decisions.”

ABC News does not fall under the FCC’s purview, but ABC’s eight-owned and operated stations are, and it wants to review whether they have violated any FCC equal employment opportunity regulations.

In addition, the FCC will also look at ABC’s policy that at least 50 percent of characters in TV pilots be from underrepresented groups.

For its part, Disney, in a statement, said, “We are reviewing the Federal Communications Commission’s letter, and we look forward to engaging with the commission to answer its questions.”

This is familiar territory for ABC News, which has already come under scrutiny from President Donald Trump. Last December, the news division settled its lawsuit with the president for $15 million over comments that anchor George Stephanopoulos made on a March 10, 2024 edition of his Sunday show, This Week.

As part of the settlement, the network included an editor’s note in the online article accompanying the broadcast, which stated: “ABC News and George Stephanopoulos regret statements regarding President Donald J. Trump made during an interview by George Stephanopoulos with Rep. Nancy Mace.”

The Associated Press reports that Disney has altered some of its D.E.I. positions in recent months. For example, it has changed the language at the beginning of some of its movies from “negative depictions and/or mistreatment of peoples or culture” to “this program is presented as originally created and may contain stereotypes or negative depictions.”

It joins NBCUniversal and Paramount Global as media companies with ties to news operations receiving the FCC treatment since the beginning of the second term of the Donald Trump administration.

The FCC does not have direct jurisdiction over NBCUniversal properties. Still, the news division could be affected by the outcome of the investigation due to its parent company, Comcast, cable and high-speed internet business, as they fall under the regulatory oversight umbrella of the FCC.

NBCUniversal is also expected to finalize the spinning off of its cable units into a separate company in the next few months, which will require government approval.

Meanwhile, Paramount Global is in the final stages of its merger with Skydance Media and needs government approval, too. On top of that, CBS News’ Sunday night newsmagazine, 60 Minutes, is facing a $20 billion lawsuit brought on by the president, who alleges the news network engaged in “deceitful” editing of a 60 Minutes interview with former Vice President Kamala Harris.

Carr made an official request for the unedited interview transcript, leading the network to publicly release the transcript and video footage of the interview on its website.
